Terms of Service

These Terms of Service ("Terms") govern your use of the Concept Collision mobile application (the "App"), developed and operated by Concept Collision ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age, that you have the legal capacity to enter into a binding agreement, and that you agree to comply with these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Concept Collision is a creative idea-generation app that takes two concepts, words, or phrases you provide and uses AI to generate unexpected, thought-provoking "collisions" between them. Generated output includes numbered entries with titles, explanatory paragraphs, tags, and a final Reflection.

To generate collisions, your inputs are transmitted through our secure Google Cloud proxy to one or more third-party AI providers (Anthropic's Claude API and, on paid tiers, xAI's Grok API). The quality, accuracy, and appropriateness of AI-generated content cannot be guaranteed. You are responsible for how you interpret and use any generated output.

3. Free and Paid Tiers

The App is available in three service tiers:

Daily limits reset each calendar day and do not carry over. Paid tiers (Explorer and Thinker) require a valid subscription processed through Stripe.

Billing and auto-renewal: Paid subscriptions are billed monthly or yearly in advance and automatically renew at the end of each billing period unless cancelled. You can cancel at any time through the Stripe customer portal, accessible via the Manage Subscription link in the app or website account menu. Cancellation takes effect at the end of the current billing period — you retain access until then.

Refunds: Subscription fees are non-refundable. We do not issue refunds or credits for partial billing periods, unused generations, or plan downgrades. If you believe you were charged in error, contact us at conceptcollisionsupport@gmail.com within 48 hours of the charge and we will review the issue. Nothing in this policy limits any rights you may have under applicable law.

We reserve the right to change tier pricing or features at any time with reasonable notice.

4. Acceptable Use and Content Policy

You agree to enter only respectful and lawful concepts into the App. You agree not to use the App to:

Automated filtering: Concept Collision uses automated content filtering to detect and block prohibited inputs before they are transmitted to any AI provider. We reserve the right to update the list of prohibited content at any time without notice.

AI provider policies: Anthropic (Claude API) and xAI (Grok API) each maintain their own content policies, which apply to all usage of their services through our platform. By using Concept Collision, you agree to comply with those policies as well.

Cookies and tracking: This app does not use cookies or tracking technologies.

Violations of this Acceptable Use Policy may result in immediate suspension or termination of your access, in our sole discretion, with or without notice.

5. Intellectual Property

The App, including its design, code, branding, and original content, is owned by Concept Collision and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You retain ownership of the concepts and phrases you enter. You grant us a limited license to transmit your inputs to third-party AI providers solely to generate the requested output. We claim no ownership over the AI-generated collisions returned to you.

6. Third-Party Services

The App relies on third-party AI providers to generate content. Your inputs may be processed by Anthropic (Claude API) and, on paid tiers, xAI (Grok API). Your use of these services through the App is also subject to their respective terms and privacy policies, which we encourage you to review. We are not responsible for the acts or omissions of these third-party providers.

7. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR YOUR PURPOSES.

Your use of the App and any reliance on AI-generated content is entirely at your own risk.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONCEPT COLLISION'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT SHALL CONCEPT COLLISION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Changes to the Service

We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice. We will make reasonable efforts to notify users of material changes to paid features. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

10. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App at our discretion if you violate these Terms, abuse the service, attempt to circumvent usage limits or subscription enforcement, or if we discontinue the service. Upon termination, all locally stored data is removed when you uninstall the App; signed-in users may request deletion of their cloud data per Section 5.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. All arbitration shall be conducted in Milwaukee, Wisconsin. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration. These Terms and any dispute shall be governed by the laws of the State of Wisconsin without regard to conflict of laws principles.
